Great find, Andy. Based on your explanation, I can say that our real problem is not the lack of visa numbers. There are enough visa numbers, but USCIS is not utilizing them.
This also tells me that an increase in visa numbers to 290,000 (or what ever number that the SKILL bill is asking for) would NOT change the situation a little bit. The end result only will be that the USCIS will end up with more number of unused visas.
Can the IV community do some thing to improve the whole situation?

You applied for your Labor and waited(establish a PD), everybody who applied after you was behind you.
After the Labor was approved, you applied for the I-140. This will determine your category/country of chargeability and will filter some of the fraud cases
After the I-140 was granted. You apply for either CP or AOS. At this point CIS/DOS knew how many applications were pending for each category/country and could move the dates smoothly.
Now the mess is so big that it takes them until February(6 months after the End of the previous Fiscal Year) to publish the number of visas issued

I know this is not the Forum to discuss this matter.
But I hope this should answer some questions
1. Home Loans if the Loan is taken from a US Bank/Mortgage lender
then it is Tax deductible because they send out a 1040 at the end of Tax year.
2. But if the Home Loan is taken from a a NON-US Bank, then it is not Tax deductible in the US. As they do not send out a 1040.
I am not sure thats correct.
Per IRS regulation Section 163 (C), as well as Publication 936, interest paid on primary and secondary residences up to an aggregate one million dollars in loan amount is tax deductible. The IRS regulation does not specify that the home must be located in the United States, and thus it seems logical that interest paid on a home loan on property in India is in fact deductible
(please consult your tax advisor for applicability to your specific tax situation).
But I hope this should answer some questions

I have talked to a representative and he very patiently explained me about the mess.
He clearly and very clearly told me that they have a deadline to send all receipts for June end and July 2nd filers by friday (tomorrow) or worst case monday.
He mentioned that they are working hard to meet this deadline.
Hope this clears the anxiety.

My only hope is somehow either the senate or the house version of employment based lost visa caoture bill gets into law, either FY2009 or FY2010.
If nothing happens to this effects we are royally screwed , until USCIS and DoL changed their interpretation for the spillover VISA numbers falling into EB-3 bucket we had some hope of catching up with some backlog, but now it seems PD will be stuck around 2001/2002.
I dont know why USCIS /DoL allowed the labor substitutions when they knew majority of the times Labor substitute option was abused by Desi consultants to get Green Cards. Thanks god they stopped this malpractice a year ago and now heavily scritinizing the pending LC applications for I-140 else the genuine folks like me who were the victims of DoL BEC and USCIS backlog would have suffered more.
I am also of the opinion similar to IV member "malagcpahije" and this is probably my last post in the IV as I dont see IV is a united organization, thier is a huge split between different factions of the employment based visa applicants and only relief we are going to get is from US policy makers, in this bad economy noone is willing to even talk about pro-immigration bills. That is not true, my lawyer who is very influential and he has some good contacts he told me that this year spill-over would be different form last year. I was stupid so didn�t believe him about July 2007, and paying it for now for not having EAD.
I know this is hard to believe especially if something comes from lawyer.
Looks like MDix is making fun of EB3-I bcoz current law doesn't allow any spillover for EB3-I category. Damn you MDix.

I am hoping this is not a typo from the mumbai consulate and USCIS visa bulletin will reflect the same.
My priority date is April 06. Does this mean that there is a chance for me to get the GC now?
How much time does it usually take for USCIS to approve the application after the priority date is current in the bulletin?
And lastly, what are the chances of USCIS staying on this date for EB2-I and not retrogressing it back to some old date (after it issues 1 yr EAD to everyone !!)?

whats wrong with you guys...you guys are filed in EB3 category...does not mean that you are less then any EB2 person.
cant you understand one simple logic? EB2 category(not an individual) will get cards sooner then EB3 category.
So if you were eligibile or had a choice, why you chose EB3????
now since you did choose, you are supporting this backgate system of porting to EB2? how do you justify that?????
you or your employer told USCIS to get a card for you in EB3 category, if you do not want that, file NEW !!!
In the eyes of americans we are skilled workers, but we all are selfish and vulnerable to white man politics!!!!
DAMN this card and I wish to see when we all cherish our self respect and does not get treated like beggars by USCIS.

If the girl is working and earning money, she has all the rights to spend the way she wants, including giving money to her parents. If she is not working, then help should be based only on humanitarian basis because we never know when one's financial situation changes. Who the hell are you EB2 people to decide that we cannot interfile? Anyway you guys can jump and crib, nothing is going to happen. There are some stupid morons arguing that Eb2's are more qualified, what a farce! Eb3 guys have been waiting longer than EB2 guys for the most part. Lets say your PD is/was current in March, April, June and July. You decided not to apply in the previous months and you finally submitted at the end of July. On the other hand i had my PD current on July and i applied. After i applied and before you applied there could be 10k(for example) applications. Now when its time to process application which one they should process yours or mine?. Obviously they will process the one that they got first. They not going to look for the PD and pull out your's from the pile of applications. Its your fault that you have not applied early enough even though your PD was current.
what happens when dates retrogress? If my PD is 2000 Jan (assume) and some one else has 2001 Jan (assume) with RDs July/2007 and Mar/2007 respectively and in August 2007 PD cut off date went back to 2000 Feb (assume) then does it mean that 2000 Jan PD is ineligible to get the adjudication before the guy with PD 2001 Jan because the RD is later for this case? Again if the answer to this question is yes then ,when the PD is set at 2000 Feb why are they accepting new AOS apps which satisfy this PD cutoff date because if they process by RD(at all times) they are not likely to consider these for adjudication anyway? Is it just for our benifit that we can get an EAD? If I go down this path I donot understand the purpose of the whole PD in this process.
